Welcome to Flaca Socials, referred to as (“we”, “our”, or “us”).
These Terms and Conditions (“Terms”) govern your use of our AI-powered social media engagement tool (“Service”). By using Flaca Socials, you (“Client”, “you”, or “your”) agree to these Terms.
1. Service Overview
Flaca Socials is a B2B software-as-a-service (SaaS) platform that creates personalized AI agents to autonomously engage on your behalf across social platforms (e.g. LinkedIn, Twitter, Instagram, Facebook). These agents like, comment, and interact with relevant audiences 24/7 to drive organic traffic and visibility.
2. Experimental Use & Risk Acknowledgement
You understand and acknowledge that Flaca Socials operates on the experimental frontier of AI-powered social engagement.
• While we follow best practices and adapt to platform norms, there is always a rare and unlikely risk of social accounts being flagged, restricted, or banned by third-party platforms.
• By using the service, you accept full responsibility for potential outcomes, including: Platform-imposed penalties, Reputational impact, Account flags or suspensions!
Flaca Socials cannot be held liable for such occurrences. Use is entirely at your own risk.
3. Client Responsibilities
To ensure optimal results and reduce risks, you are responsible for:
• Providing login or API credentials to allow secure access for your agent. We use this access solely to perform the agreed engagement services.
• Monitoring your own social media accounts regularly, including reviewing agent interactions, comments, and mentions.
• Informing us immediately if you detect any unusual or unwanted behavior from your AI agent.
• Ensuring your use of the Service aligns with the terms of the platforms you’re active on.
Neglecting to monitor your account may increase the likelihood of platform penalties or reputational harm.
4. Data Use & Privacy
We collect only the minimum information required to perform the Service. This includes login access, profile data, and preferences for tone, topics, and engagement style.
• Your data will never be sold or shared with third parties.
• All access and data are used exclusively for service performance and internal improvements.
5. Subscription & Cancellation
• Flaca Socials operates on a recurring subscription model.
• You agree to the fees and billing cycle upon sign-up.
• You may cancel at any time. No refunds for partial billing cycles.
6. Limitation of Liability
To the extent permitted by law:
• We are not liable for indirect or consequential damages, including but not limited to loss of followers, bans, or reputational harm.
• Our maximum liability is limited to the amount you paid in the 3 months prior to any claim.
7. Changes to Terms
We may modify these Terms at any time. Updates will be posted to our website. Continued use means you accept the updated terms.
8. Governing Law
The terms of the agreement are governed by German law. This means that any disputes or interpretations of the contract will be resolved according to German legal principles and regulations.
